TERMS OF USE

By downloading, installing, or using KinMed ("the App"), you ("User") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated herein by reference.

You must be at least 13 years of age to use KinMed. By using the App, you represent that you are 13 years of age or older. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

These Terms constitute a legally binding agreement between you and KinMed ("we," "us," or "our"). If you use KinMed on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use KinMed on devices you own or control, solely for your personal, non-commercial use in coordinating medication management for your family or care circle.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its underlying code.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App in a manner that could disable, overburden, or impair its servers or networks.
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.

This license terminates automatically if you violate any of these restrictions or if we terminate your access to the App.

You are solely responsible for:

• The accuracy of all medication data, dosages, schedules, and logs you enter into the App.
• All actions taken by members of your family circle, including caregivers you invite.
• Maintaining the security of your account credentials and promptly notifying us of any unauthorized access.
• Ensuring that all caregivers you add to your circle are trusted individuals and that their participation complies with these Terms.
• Verifying all medication information with a qualified healthcare professional before acting on it.

The App is designed to help caregivers coordinate and log medication administration within a family circle. It does not:

• Provide recommendations on whether a medication should be taken.
• Verify medication names, dosages, or schedules for medical accuracy or safety.
• Replace the guidance of a licensed physician, pharmacist, or other qualified healthcare professional.

Always consult a qualified healthcare professional for advice about medications and health conditions. In case of a medical emergency, call your local emergency services immediately.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by applicable law, KinMed expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The App will be available, uninterrupted, or error-free at all times.
• Notifications and reminders will be delivered on time or at all.
• Data entered by users is accurate, complete, or up to date.
• The App will meet your specific requirements or expectations.

You use KinMed at your own risk. The App is a coordination aid — always independently verify critical medication information.

To the maximum extent permitted by applicable law, KinMed and its developer shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, revenue, or goodwill.
• Personal injury or property damage arising from your use of the App.
• Any harm resulting from medication errors, missed doses, or dosing decisions made with or without the App.

In no event shall our total aggregate liability to you exceed the amount you paid us in the twelve (12) months preceding the claim — or, if you have not paid us, USD $10.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless KinMed and its developer from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of the App, including any data you enter or actions you take.
• Any medication-related decisions made by you or members of your care circle.
• Your violation of any applicable law or the rights of any third party.

We reserve the right to suspend or terminate your access to KinMed at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.

You may stop using the App at any time by deleting it from your devices. To request deletion of your account and associated data, contact us at main@luisribeiro.tech.

Upon termination, all rights granted to you under these Terms cease immediately. Sections 4, 5, 6, 7, and 9 survive termination.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of KinMed shall be subject to the exclusive jurisdiction of the courts located in Portugal, and you consent to personal jurisdiction in such courts.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify users via in-app notification or email.

Your continued use of KinMed after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
